Court Activities Criminal Division

RE-DOCKETING
If a defendant is subpoenaed for a hearing, not otherwise excused, and fails to appear, the Court will remove the case from the docket and issue a warrant for the defendant’s arrest.

In that event, the case will be held in abeyance until the defendant is arrested or returned to the court. Prior to being arrested on that warrant, a defendant may, upon payment of a $75.00 fee, have the case returned to the docket and then file a petition to have the arrest warrant dismissed. Such requests can only be handled personally by the defendant at the Clerk’s office. The defendant will not be arrested on that outstanding warrant while addressing the matter at the Clerk's Office.

The REDOCKETTING form is available at the Clerk's office and also here. The defendant may download the form, fill it out online, print it and deliver it to the Clerk’s office for file.
