Clerk of Court Fines Collection

What happens if a fine or restitution obligation is not paid as required by either a court order or payplan?

Any defendant who fails to pay a Court ordered obligation may be found in Contempt of Court and be subject to additional sanctions. All financial obligation cases that become delinquent will be placed on a docket for a "Rule Nisi" hearing. At that hearing the defendant will be given an opportunity to "Show Cause" why he or she should not be held in Contempt of Court for failure to comply with the Court's order. In all such hearings it is the defendant's obligation to prove that payments were made to the Court as required. Failing that, the Court has several options available. Those options include imposing jail time, additional fines, community service, and, in certain cases, some restructure of the financial obligation.
